What is a VA Form 10-10164?
VA Form 10-10164 is an application used by Veterans to access the health care benefits provided by the Department of Veterans Affairs. The form is available on the web or as a printable form.
If you are a Veteran, you can opt out of a Health Information Exchange (HIE) if you wish. An HIE is a secure network where the VA shares your health information with community providers. This is a way to improve health outcomes and save time. In addition to sharing medical records, the VA is able to share laboratory results, occupational health information, and prescription medications.
If you are a Veteran, but you are worried about the potential consequences of being shared, you can send a letter to the Release of the Information office at the local VA medical facility. The letters will allow you to express your preference about how health information should be shared.
For a number of years, Veterans have been required to opt-in to share their medical records with other healthcare providers. This change is part of the 2018 MISSION Act. Previously, the health information exchanged between VA and community care providers was supposed to be shared in compliance with HIPAA regulations.
Where Can I Find a VA Form 10-10164?
If you haven’t already, you can opt out of the VA Health Information Exchange (HIE). HIE is a secure electronic system that will permit many government agencies to access your private medical records.
The Health Information Exchange will give providers access to your health history, laboratory results, and occupational health information. It will also improve patient safety and care coordination.
If you do not want your information shared with the community, you can complete VA Form 10-10164. This is a form that you must submit to the Release of Information Office at your VA Medical Center. You can also download the form from the VA website.
While the new VA system is universal, it does not guarantee that you will never share your medical information with community care providers. In the event of an emergency, VA and community care providers can request your health information. However, VA will not share your health information electronically with community care providers.
Veterans who have not signed VA Form 10-0484 by September 30, 2019, will have the opportunity to opt out of the health information sharing. As part of the 2018 MISSION Act, VA has decided to change the policy for sharing health information.

The Department of Veterans Affairs will be making a major change in its medical records-sharing program in 2020. Rather than sending paper medical records out to community providers, health information will be sent through an electronic system known as the VHIE. This will ensure that providers have access to a complete view of a veteran’s health history. It will also reduce the possibility of clinical errors and test duplication.
The new VA system is part of the MISSION Act reforms. This law expanded eligibility for community care and allowed VA to share medical information with non-VA facilities. In addition, the Mission Act gave veterans access to non-VA urgent care facilities.
The Department of Veterans Affairs has been sending letters to eligible veterans’ homes informing them of the change. They also encourage providers outside the VA to receive training. A new “Opt-Out” of sharing program will allow veterans to opt out of the sharing of their medical records with other providers.
For some veterans, this means a trip to the Release of Information Office at a VA medical facility. If a veteran does not want to share their health information, they can fill out a VA Form 10-10164, which is a small form stating that a veteran does not want their health information shared with other providers.
